By accessing or using NowYouKnowMed QBank (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and NowYouKnowMed ("we", "our", or "us").
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:
You are at least 18 years of age
You have the legal capacity to enter into this agreement
You will comply with all applicable laws and regulations
You will not use the Service for any unlawful purpose
To use certain features, you must create an account. You agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password
Notify us immediately of any unauthorized use of your account
You are responsible for all activities that occur under your account. We recommend:
Using a strong, unique password
Not sharing your login credentials with others
Logging out after each session on shared devices
To prevent account sharing and protect our business model, we limit concurrent sessions to 3 devices. If you exceed this limit, you will be prompted to log out of an existing session.
The Service is provided for personal, non-commercial use only. You may use the Service to:
Study for medical board exams
Practice quiz questions
Track your progress and performance
Access educational content
You agree NOT to:
Share Your Account: Do not share your login credentials or allow others to use your account
Copy Content: Do not copy, reproduce, or redistribute quiz questions or educational materials
Automate Access: Do not use bots, scrapers, or automated tools to access the Service
Reverse Engineer: Do not attempt to decompile, reverse engineer, or extract source code
Circumvent Security: Do not bypass any security measures or access restrictions
Violate Laws: Do not use the Service for any illegal or unauthorized purpose
Harass Others: Do not harass, abuse, or harm other users
Submit False Information: Do not provide false or misleading information
All content on the Service, including but not limited to quiz questions, explanations, images, text, graphics, logos, and software, is the property of NowYouKnowMed or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only.
Any content you submit (notes, feedback, support messages) remains your property, but you grant us a license to use, modify, and display such content as necessary to provide the Service.
Access to certain features requires a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly, quarterly, or annually).
Payments are processed through third-party payment processors (Stripe/PayPal). By subscribing, you agree to their respective terms of service.
Refunds are provided on a case-by-case basis at our sole discretion. Generally, we do not provide refunds for partial subscription periods. Please contact support for refund requests.
You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.
We strive to provide reliable service, but we do not guarantee that the Service will be:
Available at all times without interruption
Free from errors, bugs, or security vulnerabilities
Compatible with all devices or browsers
We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability or fitness for a particular purpose
Accuracy, completeness, or reliability of content
That the Service will meet your requirements
That the Service will help you pass any exam
YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Damages resulting from your use or inability to use the Service
Damages resulting from unauthorized access to your account
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless NowYouKnowMed and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:
Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your violation of any applicable laws
We may terminate or suspend your account at any time for:
Violation of these Terms
Fraudulent or illegal activity
Non-payment of subscription fees
Any reason at our sole discretion
Upon termination, your right to use the Service will immediately cease, and we may delete your account and data.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
We may update these Terms from time to time. We will notify you of material changes by:
Posting the updated Terms with a new "Last Updated" date
Sending an email notification to registered users
Displaying a prominent notice on the Service
Continued use of the Service after changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
